If you are finding yourself looking down the barrel of Divorce – then these are Four Pieces that you need to know to Protect Your Money. While protecting your money is not the whole of divorce – it is one very important aspect – because you need money in your life.
Women, in particular, if you are healthy through age 50 – your life expectancy is to live to age 93 – and standing up to the ‘business part’ of your divorce is an essential part of having financial legs. Sorry to say that many women walk away from assets because they get overcome by emotion or think that they can’t negotiate the process – this is a mistake. And I am advocating fairly for men too – with the following four things that you should do immediately if your path is leading you to divorcing.
I went through a divorce that lasted for many years and was very expensive. And, as I look back, I see four things that were essential to the result that I got. I was determined that while someone had broken my heart – and I couldn’t control that – I could look forward and see that my financial net worth stayed intact. How did you do this would be your first question????!!
- And that would lead me to the first step: Have a clear picture of what you want to achieve in the outcome of the divorce – financially (and no that’s not to kill him or her because you are mad which we’ve all thought of in fleeting moments). Emotion aside here, where do you want to end up?
It can be a simple statement. I wanted to end up owning all of the property. My strategy was that if I did this, then I could recoup my costs with rising real estate values. Yours may be that you want half of everything – just get a clear statement.
- The second piece of Protect Your Money: Go to Costco (or whatever) – and get yourself a half dozen white binders. You will need these to file all of the ‘like’ papers that you will receive. In the beginning just use ‘tabs’ and file the papers by subject.
You will figure out what you have as you go along. You will develop sections like, Orders and such – this is important because you have to know what is going on in the Case.
- The third piece of Protect Your Money: Go down to the local divorce court – and get some schooling in how to file your own Motions. There will be a kind soul there who will show you the few forms and procedure that it takes to do this.
It is actually very simple – you can do some of this – and believe me, you will save a ton of legal cost. It will also show you how the legal system is working – and it is important for you to understand this.
And the fourth piece of Protect Your Money is: Find a “Consulting Attorney” – and you will have to determine if your State has provision for this – California does.
This is the most cost effective way to hire an attorney to help you with the Case – and you will have the best control of legal bills. This subject deserves an additional article which will follow.
